Web shop - concluding and terminating a sales contract

The subject and commercial purpose of the Agreement is the purchase of the selected product or service through the “www.kolagenboost.com” web store with payment of the appropriate fee – the price of the product or service. The contract is concluded by means of remote communication (Contract concluded at a distance) through internet order-web store, printed promotional messages with the purchase order, telephone with human mediation.

The Buyer is authorized to choose the possibility for the Seller to inform him about new products, products on sale, etc. (newsletter). After the successful registration (all required information has been filled in correctly), a notification of successful registration will be sent to the Customer’s e-mail.

Products that can be purchased are advertised on “www.kolagenboost.com” and with each product, there is information on the product specification, price. Price and delivery conditions are listed under “Delivery methods”.

The selection of the desired product is done by saving it in the “cart” by clicking on the link “Cart”. If the Buyer purchases a product that has been sold in the meantime, the Seller will contact the Buyer to agree on further action (refund, purchase of another product, or delivery of the same type of product when the Seller obtains it from its suppliers). The Seller, except for the just stated obligation, is not liable to the Buyer in the described case on any grounds.

The “Cart” contains all the products selected by the Buyer for purchase together with the price of the product and delivery price and the total price (VAT included). Payment methods

Shipping costs

Delivery for all orders over 299 kunas purchased in the www.kolagenboost.com online store is free for the whole of Croatia. Delivery cost for orders less than HRK 299 is HRK 19,90. In the case of cash on delivery, the delivery cost is HRK 24,90.

Products paid in accordance with the submitted offer will be delivered to the Buyer within one to three working days (except for the island, depending on the timetable of the ferry and the Dubrovnik region). Provided orders are received by 12 noon Monday through Friday, counting from the date of payment.

If you want to arrange an appropriate delivery date, please write it under NOTE so that we can convey your request to the delivery service.

If you decide to buy you can choose delivery or personal collection. The goods can also be picked up at our branch, and the only condition for personal collection is prior notice by phone or agreement via the online form.

Delivery process

Delivery is made by the Seller (through its employees) or by hiring a reputable delivery (courier) service.

Delivery is made through transport companies that provide transport services.

The products will be packed in such a way that they cannot be damaged by normal handling during transport.

When taking over the product, the buyer is obliged to check for any damage and immediately advertise it to the delivery worker who delivered the goods or refuse to take over the shipment on which external damage is visible. The buyer is obliged to sign a delivery note or delivery note when taking over the goods, and the delivery service takes it as a confirmation of collection.

In cases when the product delivered to the Buyer is different from the one he bought, he has the right to deliver the ordered product, and if this is not possible, the Buyer is entitled to a refund of the price paid, delivery, and refund costs wrongly delivered product.

In the event that the Seller is unable to deliver the purchased product within the specified period, it will notify the Buyer to agree on new delivery date. In this case, the Buyer has the right to terminate the Agreement.

Upon delivery, with the purchased product, the Buyer receives all documents accompanying the product (user manual, warranty card), invoice, and confirmation of receipt of the shipment, which he is obliged to sign. The signature on the receipt of the shipment is considered to have taken over the product without any visible damage.

Goods are insured against loss in delivery. The buyer is obliged to sign a delivery note or delivery note when taking over the goods, and the delivery service takes it as a confirmation of collection.

Shipping prices are displayed on “www.kolagenboost.com” and include the corresponding VAT.

Order status

When processing the shipment, the Buyer receives an e-mail notification about the status of his shipment.

Return

Pursuant to Article 77, paragraph 1. Of the Consumer Protection Act, the user may unilaterally terminate the Agreement within 14 (fourteen) days from the delivery of the goods to the Buyer without giving a reason.

The User is not entitled to unilaterally terminate the Agreement if the service is fully fulfilled, and the fulfillment began with his explicit prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilateral termination of the service is fully fulfilled.

Pursuant to Article 77, paragraph 5 Of the Consumer Protection Act, the user is responsible for any impairment of the goods resulting from the handling of the goods, other than that which was necessary to determine the nature, characteristics, and functionality of the goods.

Right of return

Defects for which the seller is not responsible

The seller is not responsible for defects if they were known to the buyer at the time of concluding the contract or could not remain unknown to him.

It is considered that the shortcomings that a caring person with average knowledge and experience of a person of the same profession and profession as the customer could easily notice during the usual inspection of things could not remain unknown to the buyer.

The provision of paragraph 2. of this Article shall not apply to contracts concluded by a natural person as a buyer outside his economic or professional activity with a natural or legal person acting as a seller within the scope of his economic or professional activity (consumer contract)

When the inspection is performed in the presence of both parties, the buyer is obliged to notify the seller of his remarks due to visible defects immediately, otherwise, he loses the right that belongs to him on that basis.

If the buyer has shipped the item without transshipment, and the seller was aware of or must have been aware of the possibility of such further shipment, the inspection of the item may be delayed until it arrives at the new destination, in which case the buyer must notify the seller of defects. was able to find out about them from his clients according to the regular course of events

In consumer contracts, the consumer as a buyer is not obliged to inspect the item or give it for inspection, but is obliged to notify the seller of the existence of visible defects within two months from the date of discovery of the defect

Hidden flaws

When, after receiving the goods from the buyer, it turns out that the thing has a defect that could not be detected by the usual inspection when taking over the thing, the buyer is obliged, under the threat of loss of rights, to notify the seller within two months – without delay.

The seller is not responsible for defects that appear after two years have passed since the delivery of the thing, and in the case of a trade contract six months

In the case of the sale of second-hand goods, the contracting parties may agree on a period of one year, and in the case of trade contracts, a shorter period

The contract may extend the deadlines referred to in paragraph 2. and 3. of this Article

Unilateral termination of the contract

In order for the User to be able to exercise the right to unilateral termination of the Agreement, he must inform Bio planet doo of his decision to unilaterally terminate the Agreement before the deadline.

The statement must be sent by mail to Bio planet d.o.o., Antuna Mihanovića 38a, 21 000 Split, Croatia, or by e-mail to pitanja@kolagenboost.com.

The Statement must state invoice number, invoice date, name and surname, address, telephone, fax, or e-mail address.

If the user unilaterally terminates the Agreement, he will be refunded the money received from him, including delivery costs, without delay, and no later than 14 (fourteen) days from the date when Bio planet d.o.o. receives the user’s decision to unilaterally terminate the Agreement, unless the customer has chosen another type of delivery, which is not the cheapest standard delivery offered.

The refund will be made in the same way as the user made the payment. In the event that the user agrees in another way to refund the amount paid, he does not bear any costs in relation to the refund. The refund of Bio planet d.o.o. can be made only after the goods are returned to him or after proof is provided that the goods have been sent back.

The User is obliged to hand over the goods or send them to the address Bio planet d.o.o., Predavčeva 6,10090 Zagreb, Croatia without undue delay, and in any case no later than 14 (fourteen) days from the date of his decision to unilaterally terminate the Agreement.

The direct costs of returning the goods must be borne by the user. Before terminating the Agreement, the Customer is requested to call the telephone number +385 21 209 018 or contact pitanja@kolagenboost.com in order to be explained the procedure for returning the goods.

Form for unilateral termination of the contract

RIGHT TO UNILATERAL TERMINATION OF CONTRACT CONCLUDED OUTSIDE OFFICE PREMISES OR CONCLUDED DISTANCE CONCERNED The consumer may, without stating a reason, unilaterally terminate this contract, within 14 days from the date of conclusion of the contract or upon its receipt. If the consumer exercises his right to unilateral termination, he shall not bear the costs incurred in this connection other than the direct cost of returning the goods. We can only refund the money after the goods are returned to us or after you provide us with proof that you have sent the goods back to us. You can fill in and send a copy of the unilateral termination form electronically. Confirmation of receipt of notification of unilateral termination of the contract will be sent to you, without delay, by e-mail. Complaint

If you find that the product you received is defective or dissatisfied with your first use, please contact us and follow the steps below.

Send us information with the order number, invoice number or your username and description of the complaint by e-mail to pitanja@kolagenboost.com, telephone number +385 21 209 018, via online chat or on social networks.

We will send you a confirmation of receipt of the complaint and based on your description information whether the product can be replaced with a new one, whether a refund can be obtained for the product or the product needs to be sent to an authorized service.

In cases when the product can be replaced with a new one and when money can be returned for the product, we send a delivery service to your address, which collects the advertised product and returns it to our warehouse.

When the product arrives at the warehouse, we will send you a notification about the refund/shipping of the replacement product. Refund/replacement for a new product will be made within 2-3 days, and after 15 days at the latest. Otherwise, contact us by phone at +385 21 209 018 or by e-mail at pitanja@kolagenboost.com.

If the shipment is damaged during transport, such damage is visible when you pick up the shipment, in which case we ask you not to pick up the shipment. Please contact us to check the status of the shipment as soon as possible and send a new one.
